An 81-year-old man who suffered injuries after being rear-ended by a tractor trailer was awarded a $35 million+ verdict.
LOS ANGELES, June 23, 2022 /PRNewswire-PRWeb/ -- Wilshire Law Firm is proud to announce a $35,285,942 trial verdict by Partner and senior trial attorney, Jon Teller, on behalf of his client, following a two week trial in Los Angeles County regarding a March 2018 vehicle accident.
The Plaintiff was a backseat passenger in a vehicle that was rear-ended by defendant's tractor-trailer on the 10 freeway. There were two other injured Plaintiffs in the vehicle.
As a result of the vehicle accident, Mr. Teller's client suffered a lower back injury. He underwent a 1-level lumber spine fusion surgery and then a spinal cord stimulator. He also underwent a shoulder arthroscopy.
Prior to and throughout trial, Defendant suggested the injuries were not as bad as plaintiff suggested. Defendant suggested the fusion and spinal cord stimulator surgeries were unnecessary. Defendant also suggested the past and future medical expenses were unreasonably high. Defendant disputed liability until the end, and finally admitted liability mid-trial.
At trial, Mr. Teller presented evidence that defendant's negligence caused the injuries to plaintiff. Mr. Teller presented witnesses and evidence supporting all the treatment was reasonable and necessary and that Plaintiff's life was forever changed.
Mr. Teller and the Wilshire Law Firm represented the other two plaintiffs throughout litigation. At trial another attorney was brought in to represent them. The other two plaintiffs obtained a verdict totaling $9,876,948.
The jury took two hours to deliberate and rendered a verdict in favor of plaintiff, awarding $919,942.27 in past medical expenses, $4,000,000 in future medical expenses, $9,366,000 in past non-economic damages and $21,000,000 in future non-economic damages for a total of $35,285,942.27.
In 2019, Mr. Teller sent defendant a CCP 998 offer for $999,999. After interest the judgment will likely be over $45 million.
Defendant was represented by Paul Jacobs of Jacobs and Dodd. The insurance company intervened in the case and was represented by Jim Gibbons of London Fischer at trial.
